Ksenia Rubets: courts suppression of practice of abuse by the rights from debtors on executive production

Consideration of
the matter is connected with Inmar Legal Ltd.’s representation of CJSC Nakhodka
International Terminal interests (CJSC NIT, the Terminal), being the creditor
according to court orders for the sum more than 80 million rubles from the
debtor – JSC Nakhodka Sea Fishing Port (JSC NSFP, Port, the Debtor) served.

According to
Inmar Legal Ltd.’s specialists, numerous statements for recognition of the judicial police
officer-performer acts illegal, about illegality of his actions, are directed
only on a tightening of executive productions, and, as a result, on Port’s
evasion from a duty to execute the requirement of judicial acts to pay to the
Terminal of the sums of debt.

Ksenia Rubets
focuses attention on the status of the Debtor as significant participant of
commercial activity in the Far East, and also on the bases to consider Port
actions directed only on failure to pay amounts of debt in front of the
Terminal.
